Abbreviations or reference terms
End User - any user of the Application.
The Application - the URL shortening application hosted at http://scou.se/
Short URL - a URL which has been processed by the Application. This URL does not direct visitors to any End Content, but merely points to the Long URL.
Long URL - a URL which points directly to the End Content (ie. a web address that the End User chooses to input into the Application).
End Content - the content hosting at the Long URL destination.
Removal of URLs and checks undertaken
Our application is subject to certain measures of monitoring. The Application checks URLs against a list of URLs that are not permissible or considered sources of malware, and certain other content checks may also occur (using methods both visible and not visible to End Users).
We may decline to process some URLs and we will never enter into discussion with you about this.
If we discover that you have processed URLs which point to material which is not considered legal in the United Kingdom, we reserve the right to proactively inform law enforcement authorities and divulge any details of you we hold; by using the Application you are consenting to this.
If you have a reason to believe that we should remove a URL from our index please email remove@scou.se with the URL and reason(s) for us to consider. These requests need not be lengthy, nor need they be composed by a legal advisor. Each request will be decided on its merits and we will deal with all such requests swiftly.
If you disagree with any of our Terms of Use, or that the Application is only subject to the laws of England & Wales, then you must leave the site now and not return.
The service and house rules
The Application only provides a URL shortening service, it does not host any content of its own. Nor does the Application facilitate access to internet resources, since they must already have a URL in the first instance; the Application merely provides a Short URL that in turn has been pointed to a pre-existing given Long URL by a user.
You are solely responsible for the URLs you process using the Application and any content held at the Long URL destinations. Any issues or problems - howsoever caused or raised - in relation to the content held at the Long URL destination rest with you, and you agree to fully indemnify us against any resultant action brought in relation to this.
In addition, you must abide by our house rules and agree not to process any URLS that are or lead to contents that are:
- Violations of copyright, or facilitate violations of copyright;
- Racist, sexist, homophobic, anti-Liverpudlian or otherwise discriminatory in any way;
- Spam, junk mail, viruses, or other content that is generally considered unwanted;
- Condone, endorse or encourage acts of violence or hate;
- Defamatory, illegal, libelous, obscene, pornographic, or generally just considered hostile;
- Password protected or formatted or presented in a way that prevents anyone (and in particular, us) from readily confirming that it conforms to all the above (including that you should not process any URLs that exist for the sole or main purpose of linking to files for download).
The above definitions are not exclusive and we retain the right at all times to delete, de-activate or re-direct links at will without reason, notice or consequence, and by using the Application you consent to this.
Your information
We don’t log any information about you which is directly personally identifiable.
We may log: Your IP address (relates to you as a person only by records at your Internet Service Provider, which we do not have access to); With your additional consent, your Facebook Unique ID, and the unique Facebook ID of items you post to Facebook using the Application (relates to you as a person only by records kept at Facebook, which we may access but won’t store).
When you use the Application to shorten internet addresses we log your IP address and store it. If you have connected the Application to your Facebook account, we also log your unique Facebook user ID (not your name) and the unique Facebook user ID of any links you share. We also log the IP addresses and user agent strings of those who use the Application’s short URLs. We may also deploy cookies and analytics to track visits. This information is stored on servers at our UK based hosting provider.
We log these details both for information security purposes, but primarily for the creation of statistics and useful data, such as geographical click data, and to provide an enhanced user experience.
We don’t sell or give away the very limited information we hold about you to third parties unless requested to do so by law enforcement agencies, or where we reasonably believe it is necessary to protect the interests of the Company or Application; by using the Application you are acknowledging this and are consenting to this.
All URLs you shorten using the Application are considered ‘public domain’. Where you have connected your Facebook account to the Application, you consent to us including you in a count of Facebook Friends who have shared a particular link (ie. “5 of your friends have also shared this link”).
Availability of the Application and URLs in its index
The Application creates links (Short URLs) to other links (Long URLs). We are not responsible for the content at the end destination and inclusion in our index does not indicate any endorsement. The Application retrieves some information about each URL shortened - again this does not indicate our endorsement. It is your responsibility to examine any website or content you are directed to from following an Application shortened URL, just as if you had visited such website or content without using an Application shortened URL.
The Application is provided in BETA and is an experimental application and no warranty is given to its availability, accuracy or durability of your URLs on it. The service can be terminated at any time without notice or reason, both generally and to you individually. Statistics and data are provided on a best effort basis, and are not to be counted as a reliable nor trusted source of commercial information.
Where you are using the Application to shorten URLs, responsibility for any subsequent consequences resides solely with you. Where you are using the Application to determine or acess the Long URL referred to by a Short URL, responsibility for any subsequent consequences resides solely with you.
We are not responsible for any losses or damages caused by your use or inability to use the Application nor for its non-availability (direct or indirect, howsoever caused) and you agree to fully indemnify the Company and its staff and officers at all times and hold us harmless at all times.
